SB 770 Imposes Unintended Costs on Community Associations: Urge Your Assembly Member to Vote NO

SB 770 (Allen) would make changes to Civil Code Section 4745 and remove the requirement that Owners add their association as an additional insured. The purported goal of the revised language is to simplify installation of electric vehicle (EV) charging stations in communities, and reduce the Association’s ability to restrict or slow down Owners’ installation of EV charging equipment.
The legislature is convinced that removing the additional insured language will increase EV adoption and eliminate costs that make housing unaffordable. The reality is that by removing the association as an additional insured, the law will shift some risk from the Owner onto the association. Associations may need to add to their current policies to reduce the risk, or to cover damage from Owners’ individual EV equipment.
CAI-CLAC continues to urge the bill’s authors to leave law “as is,” citing feedback from major carriers who are able to issue the required certificates, and that none appear unwilling to honor the existing requirement to name additional insured language to Owner’s individual EV coverage.
At a time when many associations are already dealing with non-renewals and astronomical increases, this change could further limit available insurance options. It is important that your legislators hear from you about the unintended consequences and additional costs this legislation will place on your community.
